THE CALVIÀ TOWN HALL WILL TAKE TO THIS MONTH'S PLENARY THE INITIAL APPROVAL OF THE MUNICIPAL ORDINANCE FOR THE PROMOTION OF THE COEXISTENCE OF CALVIÀ


It is the updating of the 'Police and Good Governance Ordinance' which changes its name and adapts its content to the reality and the laws that have been modified over the years


The municipal government team will take to this month's Plenary the initial approval of the modification of the 'Police and Good Governance Municipal Ordinance' to be renamed 'Municipal Ordinance for the Promotion of the Coexistence in Calvià'.


The modification responds to the necessity of adjusting the ordinance (of year 1991), to adapt it to the state or regional laws that have been undergoing changes. Also, the municipal regulation has been reorganised and debugged because some aspects covered in the text currently in force have been later collected in other municipal ordinances.

 

The proposal, which has been developed by a technical committee composed of the chief of the Local Police of Calvià, the legal services of the Town Hall and the various municipal departments, reflects what was proposed and agreed in the last legisltature on the Magaluf Monitoring Board -which meant, in turn, a modification of the ordinance, in May 2015-, so those agreements remain intact.

 

It is, therefore, an ordinance that regulates the coexistence between people and not a civic ordinance.


The 'Municipal Ordinance for the Promotion of the Coexistence in Calvià', goes from having 268 Articles to have 67. Thus, it is erased a whole amalgam of Articles on such diverse and heterogeneous topics such as traffic and civil protection materials; water supply, street cleaning and solid waste disposal; markets, slaughterhouses and fairs; health and hygiene; historical heritage; housing promotion and management; works on public roads; urban planning, management, execution and discipline; education and tourism, and a number of matters that have been regulated in subsequent municipal bylaws.



On the other hand, what is pursued is that the regulation becomes a more effective tool when facilitating the compliance of the rules and the payment of penalties to offenders. The fact that, in many cases, people who have to face the sanctions are visitors staying in the municipality for a short period of time, requires to mediate a very short period which allows the voluntary payment with a reduction of 50% on the amount of the penalties, providing that they are paid within the time limit that the ordinance itself establishes (10 days from the complaint). Also, a reduction of 30% is considered in the event that, once initiated the disciplinary procedure, the cash payment is made within a maximum period of 6 working days from the inception's notification.

 


Another aspect that the modified ordinance includes is the adaptation of the amount of the penalties of the law 4/2015 of protection of public safety:


Very serious infractions: from 1.500 to 3.000 euros (before: from 1.501 to 3.000)


Serious infractions: from 600 to 1.499 euros (before: from 751 to1.500 euros)


Slight infractions: from 100 to 599 euros (before: up to 750 euros)

 

It introduces administrative infractions which before the modification of the Penal Code were considered as criminal offenses, and it changes the classification (very serious, serious or slight) of certain infractions.

 

It clarifies the responsability for the infractions, making an analogy with the criminal responsibility of minors, and also it clarifies the tools that the Local Police have for the implementation of precautionary measures and confiscations.

 

It is envisaged that the 'Municipal Ordinance for the Promotion of the Coexistence in Calvià' will be initially approved at the plenary session of this month of April, to, then, put it on public display, before it is approved definitively.
